Brazil introduces bill establishing national policy on technological governance, algorithmic transparency, and digital equity in public administration

Bill No. 728/2026 establishing the National Policy on Technological Governance, Algorithmic Transparency and Digital Equity in Public Administration has been introduced to the Chamber of Deputies, applying to federal public administration and contracted service providers involved in automated systems. AI governance bill (PL 6237/2025) introduced

The Law establishing the National System for the Development, Regulation, and Governance of Artificial Intelligence (PL 6237/2025) has been introduced to the Chamber of Deputies. The Law would establish a regulatory framework for AI called the National System for the Development, Regulation, and Governance of AI (SIA), composed of a newly established Brazilian Council for Artificial Intelligence (CBIA), the Brazilian Data Protection Authority (ANPD), two newly established committees composed of experts and civil society representatives, and other related public bodies. The CBIA would be responsible for establishing guidelines and principles for AI in relation to economic development, digital sovereignty, and social inclusion, advising the President of the Republic on AI policy development, and coordinating with other authorities on sectoral issues. The ANPD would become the residual regulator and supervising authority for AI, with the power to issue binding rules, including regarding incident reporting and algorithmic impact assessments, request clarification on data used to train high-risk AI in the public sector, and publish a list of high-risk AI use cases. Further, the Law would require the ANPD and sectoral agencies to define new categories for high-risk AI, based on criteria such as impact on fundamental rights, vulnerable groups, risk of systemic cybersecurity harm, and impact on the development of children and adolescents. The statement of reasons notes that Congress is already examining Bill 2338/2023, and the Executive must be prepared to implement whichever regulatory model is adopted. The Law therefore organises Brazil’s AI governance by assigning responsibilities to the CBIA, ANPD, expert and civil-society committees, and sectoral regulators to support coordinated oversight.

Brazil introduces bill amending copyright law to prohibit unauthorised AI deepfakes

The Bill amending the Copyright Law to prohibit unauthorised use of realistic digital imitations generated by Artificial Intelligence (AI) has been introduced to the Chamber of Deputies. The Bill applies to digital content creation, social media platforms, streaming services, AI-generated media, and other online platforms that host or distribute audio-visual or performative content. It prohibits public dissemination of realistic digital imitations without express consent. It defines realistic digital imitation as audio-visual, sound, or hybrid content capable of misleading the public. Exceptions are provided for caricature, parody, satire, criticism, journalism, scientific research, artistic uses, and public interest. Violations trigger civil, administrative, and criminal sanctions, including content removal, compensation for material and moral damages, and fines up to BRL 50,000 per content item.

Brazil establishes working group for management of Brazil AI Plan

Brazil's Resolution No. 2/2025 establishing a Working Group with the purpose of operationalising the management of the Brazilian Artificial Intelligence Plan (PBIA) has entered into force. The Working Group is tasked with monitoring the PBIA's execution and proposing adjustments to the Executive Committee, organising its work into annual plans, providing information on its activities and PBIA monitoring when requested, and presenting an annual execution monitoring report for the PBIA to the Executive Committee. The group consists of 15 members and their alternates, representing various government bodies and entities, and will be coordinated by a representative from the Ministry of Science, Technology, and Innovation. BRICS+ sign declaration on AI governance

Foreign Ministers from the BRICS+ countries (Brazil, Russia, India, China, South Africa, and new members as of 1 January 2025, including Indonesia, Saudi Arabia, Egypt, Ethiopia, Iran, and the United Arab Emirates) have issued a declaration following a meeting in Rio de Janeiro, which includes commitments on AI to prioritise transparency, ethical standards, data protection, and equitable development outcomes, particularly in addressing digital and data inequalities between and within countries. The BRICS+ ministers have emphasised the importance of establishing inclusive and representative international governance for AI within the framework of the United Nations.

President of Brazil's National Data Protection Authority (ANPD) The National Data Protection Authority (ANPD) Waldemar Gonçalves has reportedly stated at the the Mobile World Congress 2025 in Barcelona that the ANPD plans to regulate AI systems in Brazil before the approval of the legal framework for AI, which is currently under final discussion in the National Congress. President Gonçalves said that (1) the ANPD is not waiting for a specific AI legal framework to begin regulating AI as the General Data Protection Law (LGPD) already mandates addressing automated decision-making; (2) the ANPD has a clear targeted focus on the regulation of algorithms on social networks that target younger audiences; and (3) he had signed a memorandum of understanding with the Spanish agency to facilitate the exchange of information and regulatory practices.

It is reported that the Brazilian Senate’s Temporary Committee on Artificial Intelligence has approved a Bill 2338/23 (i.e. a bill to regulate the use of AI in Brazil). One of the main changes was the removal of the so-called high-risk classification for AI systems used by big tech companies — algorithms for purposes such as content promotion, which will instead be addressed through specific legislation. The bill has already proceeded to debate in the plenary, with a vote scheduled on 10 December 2024.

At the conclusion of the 19th G20 Summit in Rio de Janeiro, Brazil, leaders of the G20 countries have adopted the "Rio de Janeiro Declaration" which, among other things, calls for strengthening of cooperation on the regulation of AI, taking into account the views of developing states - e.g. "To unlock the full potential of AI, equitably share its benefits, and mitigate risks, we will work together to promote international cooperation and further discussions on international governance for AI, recognizing the need to incorporate the voices of developed and developing countries."

G20 countries reportedly sign declaration on AI

It has been reported that G20 countries, except Argentina, have signed a declaration at the 10th Summit of Presidents of the G20 Parliaments in Brazil that defends AI as a means to "promote sustainable development" provided that it is regulated to be "transparent, inclusive, ethical, responsible, reliable and centred on the human being". The declaration has yet to be released to the public, but will be delivered at the G20 Summit on 18-19 November 2024.

ANPD opens public consultation on AI

The Brazilian Data Protection Authority (ANPD) has launched a public consultation on AI to gather contributions that will support the development of guidelines and regulations regarding the use of AI and the protection of personal data in Brazil. This initiative aligns with the Brazilian General Data Protection Law (LGPD), in which Article 20 grants data subjects the right to request a review of automated decisions that affect their interests. It also adheres to the ANPD's Regulatory Agenda for the 2023-2024 biennium, which includes a project to regulate AI within the context of data protection. The consultation is structured around 15 questions organized into four main pillars: (1) data subject rights; (2) LGPD principles; (3) legal basis; and (4) best practices and governance. Consultation closes on 5 December 2024.

Latin American delegates visit AI expertise centres in Europe, kickstarting AI regulation dialogue between EU and Latin America

From 14 to 18 October 2024, representatives from public institutions in Brazil, Chile and Uruguay visited AI agencies in Spain and Slovenia as part of the EU-Latin American and Caribbean (EU-LAC) Alliance to share insights and best practices on establishing AI-related institutions and regulatory policies. This visit will contribute to the upcoming EU-LAC Digital Alliance Policy Dialogue on AI, taking place in November 2024 in Santiago de Chile back-to-back with the eLAC Ministerial Conference, enhancing collaboration between the EU and LAC in key areas of AI. Further outcomes (including any regulatory insights) arising from this visit have yet to be revealed.

Latin American countries adopt sweeping AI declaration

Representatives of 17 Latin American countries (Argentina, Brazil, Chile, Colombia, Costa Rica, Cuba, Curaçao, Ecuador, Guatemala, Guyana, Honduras, Panama, Paraguay, Peru, Dominican Republic, Suriname and Uruguay) have signed the Cartagena Declaration on AI governance. The declaration includes (1) adherence to UNESCO's ethics recommendations from the AI for Good Global Summit, (2) alignment with existing soft law instruments like the OECD's AI recommendations, and (3) continuation of similar AI initiatives previously signed in Montevideo and Santiago. The text of the declaration has yet to be publicly revealed.

Brazil publishes AI plan

The Brazil Ministry of Science, Technology, and Innovations has published the Artificial Intelligence (AI) Plan (PBIA) 2024-2028 during the 5th National Conference on Science, Technology, and Innovation. Among other things, the plan notably calls for (1) a planned investment of R$23 billion in AI (especially in the public sector) over four years; and (2) creation of the National Center for Algorithmic Transparency and Trustworthy AI to ensure the transparency, security, and trustworthiness of AI systems in Brazil (including publication of guides on AI).

Brazil proposes $4 billion AI investment plan

Brazil's government has unveiled a 23 billion reais ($4.07 billion) proposal for an AI investment plan aimed at developing sustainable and socially-oriented technologies. The proposed 23.03 billion reais will be disbursed from 2024 to 2028, towards business innovation projects, AI infrastructure and development, training initiatives, public service improvements, AI regulation and "immediate impact initiatives" in sectors such as public health, agriculture, environment, business and education.

Brazil introduces bill to prohibit use of children images in AI training

The Brazilian Parliament introduced a bill (Bill 2807/2024) prohibiting use of children's images in AI systems without explicit consent from parents or legal guardians. Penalties for non-compliance, include fines, suspension of data processing activities, and a potential ban on processing children's data.
